Since one of my friends is a law studient hes been telling me after i explained the situ to him and about DS that they can be used, and for this reason ...
DS is a free to play game and as such no profit is being gained by the use of said artwork within the DS community.
only if the artwork being used was gonna generate monies only then can or could an artwork author request royalties from the use of said artwork.
hope i aint going too fast for anyone there.

That's not exactly true.
Besides, DarkSpace is free to play, but that doesn't mean its a nonprofit. They're entirely different concepts and only one applies. So no, at least as far as the staff is concerned, it still is a copyright violation.
