so...i get a paper in the mail today that states i owe the state of California $450 for the 2005 tax year. the thing is, i was never ever in california for 2005, let alone being a legal resident of cali to pay taxes. i tried calling the california tax board, but they said "were not taking phone calls". i am not paying that. i can't. so...what are my options? hiring a tax lawyer, and paying 450 anyway? or just contact my National Guard unit for options, or talk with the cali tax board directly?
and my line of thinking is that in the Army, you pay state taxes for your Home of record, not where you currently are stationed at. am i right?
is the Franchise Tax Board even real? or is it a scam?

I have met people from California and trust me, they aren't people. I mean... not REALLY. Except Leonide. I think he is from there and he's cool. All the others though. I say dont pay. Sooner or later you will be able to talk to someone directly and if they want it bad enough they will contact you (and not by paper in the mail).

Franchise Tax Board sounds like a scam. Also yes, the entire state of California is terrible. Except the northern bit. That has Stanford and wine. That part is alright.

Put your objections in writing and demand further clarification as to the basis of their assessment. Point out that you have never lived nor had any business or legal dealings in California. Send it registered so that your objections becomes a matter of record before they sell on your "debt" or start messing with your credit rating.

Hey now... I'm from Cali...
So here is the funny thing, if you are in the National Guard, any state you are stationed in has the right to tax you as a resident.
If you are active duty, then the only state you have to pay taxes in is your home state. Though many states will try to tell you otherwise. Its one of the protections afforded to military personel.
Loophole, if you are married or get married and your spouse comes to join you, then you are subjected to paying taxes in the state you are in and must change your drivers license.
If you are single or your spouse stays in your home state you are only obligated to your home states laws.
For 3 years I had an expired but exteneded drivers license because I was on the East Coast and could not come back to renew it. California accepted it as legal but North Carolina wouldn't.
While in North Carolina I didn't have to pay their state tax and California law stated if I didnt make money in the state I didnt owe state taxes. So for 3 years I didn't have to pay state tax.
The years I was stationed in Cali I had to pay state taxes.
So Cali isnt all that bad, you just have to know the tax codes and loop holes.

I would think the fact that your on active duty (or even reserve gaurd) should exempt you from that kind of thing....you know, the whole "protecting your hide" thing that your doing, and the fact that your active military alone should do that. The only tax you should be paying is in the state that your home is in. If you don't own one, and just go to apartment to apartment, then tax away i suppose, but still...
